Terms of Trade Policy 

At Pacific Coast Marine & Diesel 2024 Ltd, our Terms of Trade set out the conditions under which we supply our products and services.

Orders & Delivery

  • Orders must be accepted by us before they are binding.
  • Delivery dates are estimates only.
  • Products can be collected from our premises or delivered to your nominated address.
  • Risk passes to you once products are delivered or collected.

Products

  • Products may be supplied in instalments.
  • Second-hand products are supplied “as-is” with no warranty.
  • Customers must check products on delivery and notify us promptly of any defects.

Price & Payment

  • Prices are based on our current rates, quotes, or invoices (exclusive of GST).
  • Additional charges may apply for freight, insurance, installation, or duties.
  • Payment is due on delivery or within 7 days of invoice (unless stated otherwise).
  • Late payments may incur 2.5% monthly interest plus recovery costs.
  • We retain ownership of products until full payment is received.

Warranties & Liability

  • Products and services are warranted free from material defects in workmanship.
  • No liability for misuse, minor deviations, or defects caused by third parties.
  • Liability is limited to repair, replacement, or re-supply of the product/service.
  • We are not liable for indirect or consequential loss (e.g. lost profits).

Consumer Guarantees Act (CGA)

  • If products or services are acquired for business purposes, the CGA does not apply.
  • Customers reselling in trade must also contract out of the CGA in their agreements.

Health & Safety / Privacy

  • Both parties must comply with the Health and Safety at Work Act 2015.
  • We may collect and share personal information as needed to supply products and services, in line with the Privacy Act 2020.

Dispute Resolution

  • Disputes must first be discussed in good faith by both parties.
  • If unresolved, issues may be escalated to senior management before court action.

General

  • These terms are governed by New Zealand law (courts of Thames jurisdiction).
  • We may subcontract, assign, or vary terms where required.
  • We are not liable for events outside our control (e.g. natural disasters, pandemics).
